Fraudulent Conveyance Actions Bankruptcy Litigation/Adversary Proceedings

Learn More

A fraudulent conveyance action is brought against a debtor by a creditor or bankruptcy trustee.

It alleges that the debtor transferred assets to another party in order to avoid paying debt. The word “fraudulent” in this case does not indicate a crime. Fraudulent conveyance is a civil matter in New York as well as in most other states. There are two types of fraudulent transfers: actual and constructive. In actual fraudulent conveyance, actual intent on the part of the debtor to hinder his repayment to the creditor must be present.
